MEDIATION

 

Mediation is not for everyone.  It is important that the parties can negotiate on an equal playing field as much as possible.  Unlike the Collaborative Law process, clients' lawyers do not generally actively participate in the mediation process.  The mediation is usually performed by a Neutral facilitator called a mediator.  Generally, once an agreement has been reached, the Mediator will draft a Memorandum of Understanding, which will be taken to the parties' lawyers. This will later form the foundation for the Separation Agreement or Minutes of Settlement.  Mediation is generally not considered to be appropriate in situations where there has been ongoing violence or abuse. In many situations, mediation can be very helpful in resolving conflicts.
